Conditions of Sales

The goods specified in the invoice shall remain the property of ALBERTON STEEL & PIPE (PTY) LTD (“the seller “) until the purchase price thereof has been paid in full by the purchaser. The purchaser hereby gives the right to the seller irrevocably and in rem suam to enter the premises where the goods are kept and to remove some, should the purchaser be in default with any of the terms and conditions hereof.Unless otherwise agreed to in writing, all amounts owing to the seller shall be payable immediately upon delivery of the goods to the purchaser.

The goods are sold as is, and under no circumstances shall the seller be liable for any defects in and to the goods, whether patent or latent. More in particular, the purchaser acknowledges that in so far as any length or dimensions may be applicable to the goods sold, that such dimensions and length are approximated and under no circumstances shall the seller be liable for any deficiency, nor shall the Purchaser gain by any excess should it prove dimensions and lengths are incorrect.

The seller does not warrant that the goods are fit for the purposes for which it was purchased, and under no circumstances shall the purchaser be entitled to cancel the agreement should it prove that the goods are unfit for the purpose for which it was purchased.

 Although the seller shall not be obliged to accept the return of any goods sold, it is recorded that the purchaser shall be liable for a 15% (fifteen percent) handling charge, calculated on the invoice value of the goods in the event of the seller being prepared to accept return of such goods.

The parties hereby consent to the jurisdiction of the Magistrate Court in respect of any action arising from the sales of the goods. The purchaser hereby specifically warrants that the person accepting delivery of goods on his behalf is duly authorised to do so.

Intellectual Property & Customer Responsibility

The Customer warrants and represents that it owns and has copyright in and to any drawings, designs, specifications, or other materials ("Materials") provided to Alberton Steel & Pipe (Pty)Ltd ( “ the Supplier “) for use in the production of goods or services s alternatively that the Customer has obtained all necessary rights, licenses, and permissions for their use. The Customer further agrees that the Supplier shall not be liable for any claims, disputes, or legal actions arising from copyright infringement, trademark violations, or other intellectual property rights issues related to the provided Materials.

The Customer indemnifies and holds the Supplier harmless against any loss, damage, cost, or liability (including legal fees) arising from claims that the Materials provided infringe upon the intellectual property rights of any third party. It is the sole responsibility of the Customer to ensure that their Materials comply with all applicable laws and do not violate any third-party rights.

The Supplier reserves the right to refuse to produce or use any Materials which it reasonably suspects may infringe upon the intellectual property rights of a Third party, but such refusal does not relieve the Customer of their obligations under this clause.

  • Prices quoted exclude VAT
  • The supplier shall not be liable for any material provided by the customer. Material supplied by the customer is at the customer's own risk and will not be replaced or compensated by the supplier in the event of damage or incorrect cutting.
  • Delivery for profile cutting, unless otherwise specified, is 2-3 working days -
  • Delivery for laser cutting, unless otherwise specified, is 2-3 working days -
  • Additional working days are required for forming and will be specified upon order confirmation
